Diploma students assist at the proof for winning case of ELS alumnus

A case for unlawful discrimination again G1 Group was won yesterday on behalf of Edinburgh Law School Alumnus, Nathan Gale and his partner Robert.

Nathan Gale originally consulted the University of Edinburgh Free Legal Advice Centre (FLAC) who referred the case to the Faculty of Advocates' Free Legal Services Unit (FSLU). The case was subsequently represented by FSLU advocate, Russell Bradley and two Edinburgh Diploma students, David Gray and Kirsty McGeough, assisted at the proof.
 
The case was brought after the pair were refused access to the Polo Lounge in Glasgow last summer.  The club’s management turned the couple away, saying they had no disabled facilities. However the couple, both wheelchair users, insisted they did not need such facilities.
 
Robert Gale, who has cerebral palsy, crawled up the stairs to demonstrate he did not need any assistance. The club’s management called the police, with a staff member later saying they did so due to the couple’s “disorderly and anti-social conduct”.
 
The pair took legal action under the Equality Act 2010 in relation to provisions for disabled people and will receive £2000 in compensation after it was held at Glasgow Sheriff Court that G1 had unlawfully discriminated against the pair.
