Possession is a central concept – and a frequently-used device – in the law of property. Although certain aspects and applications of possession are clear and settled, much remains which is not. In this seminar, we will discuss three understudied topics in the law of possession. Luke Rostill (Oxford) will consider the nature of the ‘action to recover possession of land’ in English law. Jonas Atmaz Al-Sibaie (Oxford) will consider the extent to which a pledgee of personal property must have possession of that property in English law, with comparative reference to the recently-introduced (and non-possessory) “statutory pledge” of moveable property in Scotland. Finally, Alasdair Peterson (Edinburgh) will consider the ways in which a possessor’s behaviour correlates to passive or active behaviour on the part of others in the context of establishing possession.
