About the seminar
On 28th September 2022, the EU Commission published its long awaited proposal for an AI Liability Directive, alongside with a proposal for a revised product liability law. The new AI Liability Directive  is expected to complement the draft AI Act which had been proposed in February 2021 and, since then,has gained much attention even outside Europe.

The presentation will give a very brief overview of the proposed Directives and then examine whether the AI Liability Directive will be able to meet the expectations (maybe not) and wether the underlying concepts are convincing (unfortunately, no). Interestingly (the good news), altogether, the proposed legislation would focus on the responsibility of the manufacturer of AI systems rather than that of the user.

 

About the speaker
Prof Borges is since 2014 the Director of the Institute for Legal Informatics at Saarland University, and its thair of Civil Law, Legal Informatics, German and International Business Law as well as Legal Theory. His Habilitation Habilitation in 2002 had the title »Contracts in electronic business transactions. Formation of contracts, evidence, form, localisation, applicable law« at the University of Cologne. He was a judge at the Higher Regional Court (»Oberlandesgericht«) of Hamm from April 2012 until April 2015,  allocated to the 27. Civil Senate of the Higher Regional Court which focuses on Company Law and Insolvency Law. He recenty led a research project on “Explainable Intelligent Systems funded by the Volkswagenstiftung, and was the lead author of the Report by the Gesellschaft für Informatik for the German Ministry of Justice on algorithmic credit scoring.
