Description:
On 28 June 2022, the First Minister of Scotland announced that the Lord Advocate had made a reference to the UK Supreme Court on whether holding a consultative referendum on Scottish independence would be within the legislative competence of the Scottish Parliament. The UK Supreme Court heard the case over two days in October 2022, in which the court heard submissions from the Lord Advocate and from counsel representing the Advocate General for Scotland and the Scottish National Party. With the judgment expected in a few months, according to Lord Reed, the President of the Court, this discussion will explore the arguments put to the court and the possible conclusions to which the Court may come.
