The Edinburgh Centre for Global and International Law presents

New States, Statelessness, and the Postimperial Foundations of Political Order

Dr Mira Siegelberg
University Lecturer in the History of International Political Thought at Cambridge

Abstract
This chapter seeks to clarify the particular intellectual significance of the emergence of the problem of statelessness as an acknowledged reality into law and politics following the First World War. As opposed to the idea that stateless persons were seen as “legal anomalies” until the creation of human rights instruments after World War II, the entry of statelessness into international life after WWI began to inspire concrete reflections on law and rights beyond the state in a period when the future of empire, nation, sovereignty, and international law all appeared very much in question. In the decade after the war, political and legal theorists who sought to evaluate statelessness from the perspective of state theory and international law saw it as fundamentally linked to wider conceptual and theoretical debates about the foundations of political and legal order.
