In this lecture, entitled "Global Litigation in National Courts  - The View from London", Andrew Fox, Partner, and Samantha Cumming, Counsel, of Sidley Austin's London Disputes team will discuss emerging trends in commercial disputes currently before the English courts in London, and why London remains the centre of high value, complex commercial litigation involving cross-border issues. They will highlight: (i) the growth of class actions being brought in London; (ii) the impact of geopolitical issues – particularly focusing on the UK’s imposition of Russian sanctions following the ongoing conflict in Ukraine; (iii) the persistence of corporate fraud claims; and (iv) judicial review challenges brought by commercial parties. Sidley Austin is actively involved in a number of the cases which Andrew and Samantha will use to illustrate these trends, and they will offer unique insights, as well as their views and predictions as to the current and future landscape of complex litigation in London.

About the speakers

Andrew Fox (LLB Hons, 2003) is a partner at Sidley. Andrew’s practice focuses on commercial litigation and international arbitration. His litigation experience includes high-value and business-critical corporate and commercial disputes before the High Court in England and courts in many other overseas jurisdictions. Andrew’s arbitration experience includes acting for clients before tribunals constituted under ICC, LCIA, industry body and ad-hoc rules, and he has conducted such proceedings on behalf of clients as an advocate. Andrew is a member of the Young International Arbitration Group, London Court of International Arbitration, and the Young Arbitrators Forum of the ICC. 

 Samantha Cumming (PGD, 2007) is a counsel at Sidley’s London office, focusing on government litigation, white collar defense, and investigations. Samantha’s extensive litigation experience includes acting on complex and multijurisdictional commercial litigation and judicial review in the High Court and the Court of Appeal, and arbitral proceedings conducted under ICC, LCIA, and UNCITRAL arbitration rules, with seats in London and Singapore. Her extensive regulatory, investigations, and crisis management work includes acting in a number of major investigations, and advising on misconduct and reputational management.
