About the seminar
The paper is focused on the phenomenon of donation to people in potestate of the donor. Even though this kind of donation was an old practice in Roman society, the classical jurisprudence considered it void due to the lack of legal capacity of the people alieni iuris. However, it seems that starting from the Antoninian age, the jurists and the imperial chancery progressively stated the validity of these acts of liberality in presence of some elements considering the voluntas of the donor.
Through the analysis of responsa and rescripta concerning the topic, it is pointed out how this concessio worked from a juridical point of view and the differences between solutions of rescripta. Lastly, it is highlighted how this interpretatio was part of a broader phenomenon that took place in the 3rd Century AD, namely, to enhance the voluntas of the donor.
