“Digital Finance and the Forgotten Private Law”
Digital finance has fundamentally transformed many aspects of society. Ranging from the securitization of complex financial assets to the move toward digital securities trading and settlement to transactions involving digital assets like crypto, the forces of finance and technology have opened new markets and expanded existing offerings in a variety of ways. But this phenomenon has had a dark side, little noticed and largely underappreciated: it has created conditions that have not only arrested the development of the private law but also corroded it.
